How does a process server differ from a sheriff or other law enforcement officer?
Unlike sheriffs or law enforcement officers, process servers specialize in delivering legal documents and do not have law enforcement duties. They focus solely on ensuring that legal paperwork is served correctly and in compliance with legal procedures.
Why should I use a process server instead of relying on friends or family?
Process servers are trained professionals who ensure that legal documents are served in accordance with the law. Using a process server helps avoid potential challenges to the service, such as claims of improper delivery, and ensures the documents are served in a legally compliant manner.
What is the process for hiring a process server?
To hire a process server, you typically need to provide the documents to be served and relevant details about the recipient and their location. The process server will then handle the delivery and provide proof of service once completed.
Can a process server serve documents to a business or organization?
Yes, process servers can serve legal documents to businesses or organizations, usually by delivering them to a registered agent, office manager, or another authorized representative.
What should I do if the defendant is not at home?
Process servers will attempt multiple times to serve the defendant at their known address. If the defendant is not reachable at the provided address, the process server may use alternative methods or addresses if available.
How do process servers handle cases where the defendant is avoiding service?
Process servers use various techniques to locate and serve individuals who are avoiding service. This may include skip tracing, surveillance, and attempting service at different times or locations.
What information should I provide to the process server?
